Terms & Conditions

Welcome to Aquaaworld. These Terms & Conditions explain the terms governing your access to our website and your enquiries regarding our swimming pool, landscaping, aquatic facility and outdoor wellness services.

Last updated: October 2026

1. Introduction and Acceptance

This website is operated by Aquaaworld. Throughout these Terms & Conditions, references to "Aquaaworld", "we", "us" or "our" mean the business responsible for providing the relevant website content or services.

By accessing or using this website, you agree to comply with these Terms & Conditions. If you do not agree, please discontinue use of the website.

These website terms do not replace a separately signed quotation, work order, service agreement or construction contract. Where a separate agreement applies to a project, its agreed terms will govern that project to the extent provided in that agreement and permitted by applicable law.

2. About Our Services

Aquaaworld provides design, construction and related services for swimming pools, aquatic facilities, landscaping, water features and outdoor wellness spaces, subject to the services offered and agreed for each project.

Depending on the project, services may include:

  • Residential and luxury swimming pool design and construction.
  • Commercial, institutional and sports swimming pools.
  • Fibreglass and other ready-made pool solutions.
  • Pool renovation, repair and maintenance services.
  • Water features, fountains and associated installations.
  • Landscaping, hardscape and softscape solutions.
  • Selected heating, filtration, lighting and pool equipment.
  • Outdoor wellness installations, subject to availability.

The actual scope, specifications, availability and delivery of any service will be confirmed separately for the relevant project or service engagement.

3. Website Information and Accuracy

We make reasonable efforts to keep website content accurate and up to date. However, descriptions, photographs, illustrations, product information, indicative prices and project examples are provided for general informational purposes and may not represent the exact specifications of a future project.

Actual outcomes may vary according to site conditions, dimensions, materials, selected finishes, equipment, engineering requirements and other project-specific factors.

Website content should not be treated as a final technical specification, construction drawing, price quotation or guarantee unless expressly confirmed in writing by Aquaaworld.

4. Enquiries, Quotations and Site Assessments

Submitting an enquiry through our website, email, telephone or other communication channel does not automatically create a contract or guarantee that a project will be undertaken.

Quotations may depend on the information supplied by the customer, site inspections, measurements, technical assessments, selected materials and the agreed scope of work.

Any quotation should be reviewed for its validity period, inclusions, exclusions, taxes, payment milestones, delivery assumptions and other stated conditions before acceptance. Additional work or changes may require a revised quotation or written approval.

5. Project Scope and Customer Responsibilities

Customers are responsible for providing accurate project information and communicating their requirements clearly. Where applicable, customers must arrange access to the site and disclose known site restrictions or relevant conditions.

Depending on the agreed project, customer responsibilities may include:

  • Providing accurate property, boundary and site information.
  • Providing reasonable access for inspections and authorised work.
  • Obtaining approvals or permissions assigned to the customer.
  • Identifying existing utilities and known site constraints.
  • Reviewing and approving drawings, finishes and specifications.
  • Making payments in accordance with the signed agreement.

Responsibilities relating to permits, utilities, excavation, structural works, site preparation and third-party contractors must be established in the relevant project agreement.

6. Pricing, Taxes and Payments

Project prices and payment obligations are determined by the accepted quotation, purchase order or signed contract. Unless expressly stated otherwise, website content does not constitute a binding price offer.

Applicable taxes, transport, site preparation, civil works, additional equipment and other costs will be handled as specified in the relevant quotation or agreement.

Payment amounts, due dates, advances, milestones, late payment consequences and any applicable charges must be stated in the agreed commercial documents. No additional fee should be assumed solely from this website policy.

7. Design Changes and Additional Work

Changes to approved drawings, dimensions, finishes, equipment, site conditions or the project scope may affect the price, materials, construction sequence and completion schedule.

Changes should be documented and approved by the relevant parties before the additional work proceeds, except where urgent action is reasonably necessary for safety or to prevent damage and is permitted under the project agreement.

Any resulting price adjustment or schedule revision will be addressed in accordance with the applicable contract.

8. Project Timelines and Delays

Project schedules are established according to the agreed scope, site readiness, design approvals, material availability, workforce coordination and other relevant conditions.

Timelines may be affected by weather, unexpected ground conditions, changes requested by the customer, approval delays, supply interruptions, utility constraints or other circumstances outside a party's reasonable control.

Any revised completion date, extension or responsibility for delay will be handled under the relevant project agreement and applicable law.

9. Materials, Finishes and Substitutions

Materials, finishes, equipment and other specifications should be identified in the approved quotation or project documents wherever applicable.

Samples, photographs and digital renderings may differ slightly from the final installed appearance due to lighting, manufacturing variations, screen settings or site conditions.

Any material or equipment substitution that materially affects the agreed specification should be addressed through the applicable approval process and project agreement.

10. Construction Quality and Handover

Construction and installation work will be performed according to the scope and technical requirements agreed for the project, subject to applicable laws and standards.

Inspections, testing, commissioning, documentation, handover requirements and customer sign-off will be governed by the relevant project agreement.

Customers should follow the operating, cleaning, water treatment and maintenance guidance provided for their particular pool or installed equipment.

11. Warranty and Defect Reporting

Warranty coverage, where provided, is governed by the applicable written warranty or project agreement. The relevant documents should specify the coverage period, covered components, exclusions and claim procedure.

Customers should report suspected defects promptly and provide reasonable supporting information, such as photographs, service records or details of the issue.

Warranty coverage may be affected by misuse, unauthorised alterations, improper maintenance, unsuitable water chemistry, external damage or other exclusions expressly stated in the applicable warranty and permitted by law.

Nothing in these Terms & Conditions excludes any consumer or other legal rights that cannot lawfully be excluded or restricted.

12. Maintenance and Repair Services

Pool maintenance, annual maintenance contracts, inspections and repair services are subject to the agreed service scope, frequency, pricing and exclusions.

Customers should promptly report leaks, equipment faults, unusual water conditions or other concerns that may affect the pool's safe operation.

Routine maintenance and repair services do not replace the customer's responsibility to operate the pool safely, supervise swimmers and follow equipment instructions.

13. Pool Safety and Customer Use

Swimming pools and water features involve inherent risks. Owners and operators must take appropriate measures to protect users and comply with applicable safety requirements.

  • Provide appropriate supervision, especially for children.
  • Maintain suitable barriers and access controls where required.
  • Keep safety equipment accessible where appropriate.
  • Follow pool equipment and water treatment instructions.
  • Arrange qualified inspection and servicing when required.

Design or construction services do not replace ongoing supervision, safe operation or the responsibilities of the pool owner or operator.

14. Intellectual Property

Unless otherwise stated, website text, branding, graphics, photographs, illustrations, layouts and other materials are owned by Aquaaworld or used under applicable permission or licence.

You may access and use the website for lawful personal or business enquiry purposes. You must not reproduce, modify, distribute, publish or commercially exploit protected website content without the necessary authorisation, except where permitted by law.

Ownership and permitted use of project-specific drawings, designs, plans and other deliverables will be governed by the relevant agreement and applicable law.

15. Website Use and Prohibited Activities

You agree not to use this website in a manner that is unlawful, fraudulent, harmful or likely to disrupt its operation.

Prohibited activities include, to the extent applicable:

  • Attempting unauthorised access to website systems or data.
  • Introducing malicious code or harmful software.
  • Submitting false, misleading or impersonated enquiries.
  • Interfering with website security, availability or functionality.
  • Using website content in violation of applicable rights or laws.

We may take reasonable steps to protect the website, investigate suspected misuse and comply with legal obligations.

16. Third-Party Services and Links

The website may contain links to third-party websites, maps, social media platforms, payment services or other external resources for convenience.

Third-party services operate under their own terms and privacy practices. Unless expressly agreed otherwise, Aquaaworld does not control external websites and is not responsible for their independent content, availability or practices.

You should review the relevant third party's terms before using its services or submitting information to it.

17. Privacy and Personal Information

Personal information submitted through our website or communication channels is handled in accordance with our Privacy Policy and applicable data protection laws.

Please review our Privacy Policy to understand how information may be collected, used, disclosed and protected.

Do not submit passwords, payment card details or other sensitive information through general enquiry forms unless the relevant channel is specifically intended and secured for that purpose.

18. Disclaimers

This website and its general informational content are provided on an "as available" basis. We do not guarantee uninterrupted availability or that every item of website content will always be complete, current or error-free.

Nothing on this website constitutes professional engineering, structural, legal or other specialist advice for a particular property. Project-specific decisions should be based on appropriate assessments and advice from qualified professionals.

Any disclaimer in this section applies only to the extent permitted by applicable law and does not override an express written commitment or a non-excludable legal right.

19. Limitation of Liability

To the extent permitted by applicable law, Aquaaworld will not be responsible for losses arising solely from a user's inability to access this website, reliance on general website information without appropriate verification, or independent third-party websites and services.

This section does not exclude or restrict liability where such exclusion or restriction is prohibited by law, including any liability that cannot lawfully be limited.

Liability relating to a particular construction project, product or service will be determined under the applicable contract and relevant law.

20. Cancellation, Suspension and Termination

Cancellation, suspension, termination, refunds and any associated charges for a project or service are governed by the accepted quotation, service agreement or construction contract, together with applicable law.

Customers should review these provisions before confirming a booking or authorising work. No general cancellation period or refund entitlement is created by this section unless required by law or expressly agreed in writing.

We may restrict access to the website where reasonably necessary for security, maintenance, legal compliance or response to misuse.

21. Events Beyond Reasonable Control

A party's performance may be affected by circumstances beyond its reasonable control, such as natural disasters, severe weather, government restrictions, major transport disruptions, widespread supply interruptions or other qualifying events.

The impact of such events, including any extensions, mitigation steps or termination rights, will be determined by the relevant project agreement and applicable law.

22. Changes to These Terms

We may revise these Terms & Conditions to reflect changes to our website, services, operational practices or applicable legal requirements.

The latest version will be published on this page with an updated revision date. Changes will apply subject to applicable law and will not automatically amend an existing signed contract unless agreed or otherwise legally permitted.

23. Governing Law and Dispute Resolution

These Terms & Conditions are subject to the laws of India, to the extent applicable. Disputes relating to a specific project may also be governed by the dispute resolution and jurisdiction provisions in the applicable signed agreement.

Any applicable court jurisdiction, mandatory consumer protections and statutory rights will be determined in accordance with relevant law. Nothing in these terms removes a right that cannot lawfully be waived.

24. Severability and Entire Agreement

If any provision of these Terms & Conditions is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

These website terms, together with any applicable policies and the relevant signed project or service agreement, describe the terms applicable to the relevant subject matter. A project-specific agreement takes precedence where its terms expressly address the same matter and such precedence is legally permitted.
